Cohabitation Disputes
The law in regards to disputes between unmarried couples is a grey area that does not offer the parties involved the same protections as divorce or dissolutions do. MBS Family Law is experienced in helping clients deal with the financial and family issues that occur when a relationship breaks down.
Currently in England and Wales, relationships (including same-sex relationships not in a civil partnership) have no special status. When non-married partners (or non-civil partnership partners) separate, a complex area of trust and property legislation is used to determine the outcome. This legislation is outside the divorce and separation legislation. MBS Family Law is able to assist with:
Dealing with the family home and other assets
Children matters
Child support and financial provision for the children of the family
Financial settlements
Inheritance claims
The preparation of cohabitation agreements and the consequences of signing the same
Clients are sometimes disappointed to learn that financial settlements are based largely on what income or assets they put into the relationship, not on an equitable split of the assets accumulated during the relationship. MBS Family Law will analyse your contributions to the household, the gifts and inheritances you received during the relationship, and the assets you owned before the relationship began.
