Arrangements for Children
It can often be difficult to manage separating when there are children involved. This is a naturally emotional period for all involved. Most parents can reach an agreement on how to care for their children, where they should live, etc. Where that is not possible MBS Family Law can provide advice and assistance on how the care of the children should be decided.
The court places the welfare of children as its paramount concern when dealing with any matters concerning children. It is therefore important to help parents try to resolve matters in a non-confrontational manner, for example through mediation. Where an agreement cannot be reached MBS Family Law can assist in making applications to Court to determine any such issues.
MBS Family Law has extensive experience in the following areas:
Arrangements for the care of the children
Protective measures such as prohibited steps orders
Specific issues order – terms related to a specific issue such as schooling, religious upbringing, and medical intervention
Grandparents, aunts, and uncles who wish to have ongoing contact with a child. These family members cannot apply for residence directly; they need permission from the court to seek residence or contact. Each case must be evaluated individually
Relocating with the children to another part of the country or abroad
Parental responsibility
